These Terms and Conditions (“Terms”) govern your access to and use of the websites, forms, communications, and services of Soon and Forever Homes (“Soon and Forever Homes,” “we,” “us,” or “our”). By using the Services, you agree to these Terms.

3) Real estate activities

We buy, sell, and/or market residential real estate and related services. Any offers to purchase or sell property are subject to written agreements signed by the parties, contingencies, due diligence, disclosures, and applicable laws. We may work with licensed real estate professionals and third-party vendors.

4) Eligibility and user responsibilities

You must be at least 18 to use the Services. You agree to:

Use the Services lawfully and not for fraudulent, abusive, or harmful purposes
Not interfere with or disrupt the Services, or attempt to access data without authorization

5) Communications; SMS, calls, and email

Optional consent: If you check the optional consent box on our forms or otherwise opt in, you agree to receive SMS and/or phone calls from Soon and Forever Homes regarding your inquiry, property updates, appointment reminders, and limited promotional messages. Message frequency varies. Consent is not required to obtain services.
Opt-out and help: Text STOP to cancel at any time. Text HELP for help or contact us using the information above.
Costs and delivery: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Identification: Our first SMS will identify Soon and Forever Homes.
Records: We maintain consent records (date/time, IP address, form URL, and disclosure text).
Email: You can opt out of marketing emails via unsubscribe links; we may still send transactional emails related to your requests or transactions.

6) Privacy

Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, and share information. The Privacy Policy is incorporated by reference into these Terms.

7) Intellectual property

The Services, including text, graphics, logos, and other content, are owned by Soon and Forever Homes or our licensors and are protected by law. You may not copy, distribute, modify, or create derivative works without our prior written permission, except for your personal, non-commercial use of publicly available content.

8) User content

If you submit content (e.g., messages, comments, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content to operate and improve the Services. You represent that you have the rights to provide such content and that it is lawful and not defamatory or infringing.

9) Third-party services and links

We may link to or integrate third-party services. We do not control and are not responsible for third-party content, products, or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that information is current, complete, or accurate.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOON AND FOREVER HOMES AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow exclusion of certain damages; some limitations may not apply to you.

12) Indemnification

You agree to indemnify and hold Soon and Forever Homes harmless from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.
